DISSENTING OPINION OF JUDGE HSU MO
DISSENTING OPINION OF JUDGE KLAESTAD
The Hellenic Government, which has not made any declaration
under Article 36 (2) of the Court's Statute, contends that the juris-
diction of the Court can be derived from Article 29 of the Treaty
of Commerce and Navigation of 1926 between Great Britain and
Greece. The text of this Article is as follows :

The Court has found that it has jurisdiction to decide whether
the United Kingdom is under an obligation to submit to arbitra-
tion, in accordance with the Declaration of 1926, the clifference
as to the validity of tlie Ambatieloç clairn, in so far as this claim
is based on .the Treaty of 1886. 1 regret that 1 am unable to concur
in this decision for the follo~ing reasons :

1 greatly regret that 1 am able onlv to concur in part with
the operative portion of the Judgment, and as 1 also disagree
with the way in which the Court arrives at its decision, 1 think
that 1 should indicate mv main reasons for my view and the
conclusions which 1 draw from those reasons.

1 have voted in favour of the first finding of the Court, namely,
"that it is without jurisdiction to decide on the merits of the
Ambatielos claim", though 1 go further than that and consider
that the Court has no jurisdiction at al1 in this case. 1 regret
that 1 am not able to concur in the second finding of the Court.
