DISSENTING OPINION OF JUDGE HIGGINS

1. 1 agree with al1that the Court has to Sayas to why it must render
this Opinion and much that it has to say on the substance of the question
put to it.1have also voted in favour of paragraphs 2A, 2B, 2C, 2D and
2F of the dispositif. The first four of these findings are in a sense stepping
stones to the heart of the matter, which is to be found in paragraph 2E.

DISSENTING OPINION OF JUDGE KOROMA

Itis a matter of profound regret to me that 1 have been compelled to
append this dissenting opinion to the Advisory Opinion rendered by the
Court, as 1 fundamentally disagree with its finding - secured by the
President's castingvote - that:
"in viewof the current state of international law, and of the elements
